Martin C. Carlson, United States Attorney for the Middle District of Pennsylvania, announced that a man who distributed cocaine and crack cocaine in Carbon County during 2005 was sentenced today by U.S. District Court Judge James M. Munley to serve 115 months in prison.
Carlson stated that Brian Leyba, also known as “Boggs,” age 27, was sentenced after previously pleading guilty to conspiracy to distribute more than 50 grams of crack cocaine and more than five kilograms of cocaine.
Leyba pleaded guilty in September 2007. He was charged as a result of an investigation by the Federal Bureau of Investigation and the Pennsylvania State Police. Leyba was one of more than twenty people charged in the case. All but two of the defendants have entered guilty pleas to drug charges. Christopher Berry and Alan Holmes are awaiting trial.
Judge Munley also ordered Leyba to be placed on five years of supervised release after serving his prison sentence. Leyba must also pay a $100 special assessment.
Carlson noted that the case was prosecuted by Assistant U.S. Attorney Francis P. Sempa.
